PRIVACY POLICY

This Privacy Policy (the “Privacy Policy“) describes the types of information Beth Hoag, Registered Physiotherapist (“I”, or “me”) collect from you (“you” or “your“) when you access my services, including the enhancements, features, related website, and contents which relate to the Cancer Rehab Space Online Programs & Workshops (the “Program”). It also describes how I use and disclose such information, as well as your rights with respect to my collection, use, and disclosure of such information.

By downloading or accessing the Program, you agree that I may collect, use, and disclose Personal Data, Aggregate Information, and Cookies pursuant to this Privacy Policy.

I may change or update the Privacy Policy from time to time by posting the revised version on my website. Therefore, you should periodically verify the date of this Privacy Policy to ensure that you are familiar with the most up-to-date version, as the most up-to-date version will govern your use of the Program.

INFORMATION I COLLECT

When you use the Program, I may collect three types of information:

 (1) Personal Data

Personal Data is any information directly or indirectly relating to an identified or identifiable individual, such as a name, an identification number, location data, an online identifier or one or more factors specific to that individual.

(2) Aggregate Information

Aggregate Information is information about your activities on or in connection with the Program that typically cannot be used to identify, locate, or contact you. For example, Aggregate Information includes information regarding the frequency of use of the Program, quantity and type of data entered when using the Program, components of the Program most frequently accessed, and browser types used to access the Program.

(3) Cookies, etc.

Cookies, beacons, device identifiers, or similar technologies (referred to for convenience as “Cookies”) are small pieces of data placed on your device that your web browser or device uses to access the Program and that permit me to track your activity on the Program. I obtain information from Cookies when, for example, you visit my website. You may turn off cookies in your browser or device settings, but this may limit functionality of the Program. Cookies help analyze usage and provide certain functionality. Cookies don’t contain Personal Data and for that reason, I treat Cookies in the same manner as I treat Aggregate Information. If Cookies do contain Personal Data, such Personal Data will only be used or disclosed in the same manner as other Personal Data pursuant to this Privacy Policy. Cookies cannot be used as a malicious tool.

COLLECTING PERSONAL DATA

I collect Personal Data when:

(1) you sign up for the Program;

(2) you use certain features of the Program that require the collection of Personal Data in order for those features to function;

(3) you voluntarily enter or upload Personal Data to or through the Program; and

(4) you communicate with me, whether through the Program or through another form of communication, such as by e-mail or telephone.

COLLECTING AGGREGATE INFORMATION

I collect Aggregate Information resulting from your use of the Program.

USING AND SHARING PERSONAL DATA

I use Personal Data:

(1) to provide the Program;

(2) to improve the Program;

(3) to communicate with you in response to any of your questions and requests; and

(4) to provide relevant marketing and other information to you, but only if, and to the extent that, you have consented to me providing such marketing and other information to you in accordance with applicable laws. In such a case, I will provide an easy link to permit you to "opt-out" of receiving future marketing communications.

In rare cases, I may be required to share certain information with legal authorities. In such a case, I will provide only the minimum amount of information required and, unless prohibited by law, I will notify you of the Personal Data I have provided.

I may share Personal Data with third party service providers as I deem necessary for such third party service providers to perform their duties required for the Program to function. For example, the Program may utilize payment processers and hosting providers. A list of third party service providers used by me is available to you upon your request. These third party service providers are not authorized to retain, share, store or use Personal Data for any purposes other than to provide the services for which they have been retained to provide.

I do not sell or otherwise disseminate your Personal Data to third parties, except as set out in this Privacy Policy.

USING AND SHARING AGGREGATE INFORMATION

I use Aggregate Information:

(1) to provide the Program;

(2) to improve the Program;

(3) to monitor usage of the Program;

(4) to analyze usage of the Program;

(5) to research, compile, and report on usage trends, user demographics, and user behaviors; and

(6) for other legitimate business purposes.

I may share Aggregate Information with its affiliates and certain third parties, such as third party service providers I use to provide the Program.

Aggregate Information is anonymized and does not have the capacity to be used to identify an individual. In other words, I may share this information, but no Personal Data will be disclosed to third parties.

LOCATION INFORMATION

I may use the Program to collect and use location information to provide certain functionality. All such information will be governed by this Privacy Policy.

EXTERNAL LINKS

When you click on links in my on-line store, if applicable, or through my website, they may direct you away from my website. I am not responsible for the privacy practices of other sites and encourage you to read their respective privacy policies. Nonetheless, I seek to protect the integrity of my website and welcome any feedback about these sites.

 HOW DO I OBTAIN YOUR CONSENT?

 By using the Program, you are expressly consenting to my collecting Personal Data and using it for the purposes as set out in this Privacy Policy.

If I ask for your Personal Data for reasons such as marketing, I will ask you for your consent. SECURITY AND DATA PROTECTION

I take appropriate security measures to protect Personal Data against unauthorized access, alteration, disclosure or destruction.

Such measures include internal reviews of my data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where Personal Data is stored.

I restrict access to Personal Data to my contractors, employees, service providers and agents who need to know such information in order to operate, develop or improve the Program.  These individuals are bound by confidentiality obligations and are required to treat such Personal Data confidentially and in accordance with this Privacy Policy.

DATA PROCESSING AND GDPR

I process Personal Data only for the purposes for which it was collected and in accordance with this Privacy Policy. I take reasonable steps to ensure that Personal Data I process is accurate, complete, and current.

Effective May 25th, 2018, individuals located in or originating from certain regions, such as the European Economic Area, have certain rights in relation to their Personal Data, as outlined in Regulation (EU) 2016/679 (General Data Protection Regulation, commonly referred to as “GDPR”). To the extent I have access to, or processes Personal Data for individuals who are subject to GDPR, I will adhere to the requirements of GDPR.

I may transfer your Personal Data to countries other than the one in which you live.

You have the right to access your Personal Data and require me to update, delete or correct this information. The Program permits you to update this information directly. I will take all reasonable steps to update or correct Personal Data in my possession.

FINANCIAL INFORMATION

 I may require certain financial information, such as credit card information. I will not share this financial information, other than the financial institutions involved in processing your payment. At all times, I will comply in all respects with applicable consumer protection laws.

 

CHILDREN AND AGE OF CONSENT

By using my website, you represent that you are at least the age of majority in your jurisdiction of residence (and, in any case, you are at least 18 years old), or that you are the age of majority in your jurisdiction of residence and you have given me your consent to allow any of your minor dependents to use this website.

 I don’t knowingly collect or solicit Personal Data from anyone under the age of 18 or knowingly allow such persons to register. If I become aware that I have collected Personal Data from a child under the relevant age without parental consent, I will take steps to delete that information.

 

CANADA'S ANTI-SPAM LEGISLATION (CASL)

The CASL is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

To be in accordance with CASL, I agree to the following:

  • Not use false or misleading subjects or email addresses.
  • Identify the message as an advertisement in some reasonable way.
  • Include the physical address of my business or site headquarters.
  • Honor opt-out/unsubscribe requests quickly.
  • Allow users to unsubscribe by using the link at the bottom of each email
  • If at any time you would like to unsubscribe from receiving future emails, you can follow the instructions at the bottom of each email and I will promptly remove you from correspondence.

 

CHANGES TO THIS PRIVACY POLICY

I reserve the right to modify, change or replace this Privacy Policy at any time for any reason without notice to you, so please take the time to review it frequently. Changes and clarifications will take effect immediately upon their posting on my website. If I make material changes to this Privacy Policy, I will notify you here that it has been updated, so that you are aware of what information I collect, how I use it, and under what circumstances, if any, I use and/or disclose such information.

If my business is acquired or merged with another company, your information may be transferred to the new owners so that they may continue to offer or sell products to you under the Program.
